This End User License Agreement ("EULA") is a legally binding contract between you ("Licensee") and
Thomas-Christian Leone, Caminho Serrado das Lilás 41, 9370-635 Calheta, Portugal ("Licensor"),
for the use of the software DashCoreX ("Software").

1. Scope of the Agreement

This End User License Agreement (EULA) governs the use of the software DashCoreX, including all associated digital content, components, configuration files, documentation, and other elements
provided to the Licensee under this license agreement via electronic delivery without a physical data carrier.

The software is made available to the Licensee solely for use in accordance with the terms of this EULA.
By acquiring or using the software, the Licensee agrees to the following terms and conditions.

2. License Grant

The licensor grants the licensee a non-exclusive, non-transferable, and perpetual license to use the software in accordance with the terms of this EULA.

The software may only be used with a valid license key issued by the payment and licensing provider Gumroad.
The license is not tied to specific devices.
License verification is performed by entering the valid license key within the software and subsequently verifying it through the official Gumroad License API.
Sharing the license key with third parties is prohibited. The licensee is responsible for keeping their license key confidential.

The trial version is limited to 7 calendar days from the first use. After this period, a valid license is required.

3. Restrictions

The Licensee is not permitted to:

decompile, reverse engineer, disassemble, or otherwise convert the software into source code
rent, lease, or sublicense the software
redistribute the software publicly without written permission
to circumvent technical protection measures, in particular those related to copy protection, license verification, or protection against multiple device usage
manipulate license files or mechanisms

4. Ownership and Copyright

The software remains the intellectual property of the Licensor.
The Licensee receives no ownership rights, only a right of use under this EULA.

The software contains third-party components licensed under open-source licenses (e.g., MIT, Apache-2.0, MPL-2.0).
A complete list can be found in the file THIRD_PARTY_LICENSES.txt located in the installation directory.

5. Updates and Support

The Licensor is not obligated to provide updates or technical support.
Updates may be subject to additional license terms, which will be presented to the user prior to installation.

6. Data Protection

DashCoreX stores and processes personal data exclusively in connection with license issuance and verification.
This includes, in particular: the license key, email address, an anonymized device hash (derived from the hostname), name, customer ID, and activation timestamp.

License verification is performed manually by the user via a secure (HTTPS) connection.
No continuous or automatic background data transmission takes place.

7. Warranty Disclaimer

The software is provided "as is", without any warranties of any kind.
The Licensor is not liable for errors, data loss, or damages arising from the use of the software,
to the extent permitted by law.

This exclusion does not apply where mandatory consumer protection laws provide otherwise.

8. Limitation of Liability

The Licensor's liability is limited – except in cases of intent or gross negligence – to the amount paid for the license.
No liability for indirect or consequential damages (e.g., data loss, lost profits).
Exceptions apply in cases of personal injury or mandatory liability, such as under product liability laws or in the event of injury to life, body, or health.

9. Termination

This license is automatically terminated:

in the event of a breach of this EULA
upon revocation/deactivation due to license violation (e.g., device protection circumvention)

In the event of termination:

all use of the software must cease
all copies must be deleted
revocation may occur without refund

10. Applicable Law

This agreement is governed by the laws of the Republic of Portugal, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, the mandatory consumer protection laws of the country in which they habitually reside shall also apply.

For business customers and legal entities, the exclusive place of jurisdiction shall be Calheta / Madeira (Portugal).

11. Miscellaneous

If any part of this EULA is deemed invalid, the remaining provisions remain effective.
By using DashCoreX, you agree to these terms.

Este Acordo de Licença de Usuário Final (“EULA”) é um contrato legal entre você (“Licenciado”) e Thomas-Christian Leone, Caminho Serrado das Lilás 41, 9370-635 Calheta, Portugal (“Licenciante”), referente ao uso do software “DashCoreX” (“Software”).

1. Escopo do Acordo

Este Acordo de Licença de Usuário Final (EULA) rege o uso do software DashCoreX, incluindo todo o conteúdo digital associado, componentes, arquivos de configuração, documentação e outros elementos
fornecidos ao Licenciado sob este contrato de licença por meio de entrega eletrônica, sem mídia física.

O software é disponibilizado ao Licenciado exclusivamente para uso de acordo com os termos desta EULA.
Ao adquirir ou utilizar o software, o Licenciado concorda com os seguintes termos e condições.

2. Concessão de Licença

O licenciante concede ao licenciado uma licença não exclusiva, intransferível e perpétua para utilizar o software de acordo com os termos desta EULA.

O software só pode ser utilizado com uma chave de licença válida emitida pelo fornecedor de pagamento e licenciamento Gumroad.
A licença não está vinculada a dispositivos específicos.
A verificação da licença é efetuada mediante a introdução da chave de licença válida no software e a subsequente verificação através da API oficial de Licenças do Gumroad.
É proibida a partilha da chave de licença com terceiros. O licenciado é responsável por manter a confidencialidade da sua chave de licença.

A versão de teste é limitada a 7 dias corridos a partir da primeira utilização. Após este período, é necessária uma licença válida.

3. Restrições

O Licenciado não está autorizado a:

decompilar, fazer engenharia reversa, desmontar ou de qualquer forma converter o software em código-fonte
alugar, arrendar ou sublicenciar o software
redistribuir publicamente o software sem permissão por escrito
contornar medidas técnicas de proteção, em especial aquelas relacionadas à proteção contra cópia, verificação de licença ou restrição de uso em múltiplos dispositivos
manipular arquivos ou mecanismos de licença

4. Propriedade e Direitos Autorais

O software continua sendo propriedade intelectual do Licenciante.
O Licenciado não adquire direitos de propriedade, apenas um direito de uso conforme definido nesta EULA.

O software contém componentes de terceiros licenciados sob licenças de código aberto (por exemplo, MIT, Apache-2.0, MPL-2.0).
Uma lista completa pode ser encontrada no arquivo THIRD_PARTY_LICENSES.txt localizado no diretório de instalação.

5. Atualizações e Suporte

O Licenciante não é obrigado a fornecer atualizações ou suporte técnico.
As atualizações podem estar sujeitas a termos de licença adicionais, que serão apresentados ao usuário antes da instalação.

6. Proteção de Dados

O DashCoreX armazena e processa dados pessoais exclusivamente em conexão com a emissão e verificação de licenças.
Isso inclui, em particular: a chave de licença, endereço de e-mail, um hash anonimizado do dispositivo (derivado do nome do host), nome, ID do cliente e carimbo de data/hora da ativação.

A verificação da licença é realizada manualmente pelo usuário por meio de uma conexão segura (HTTPS).
Não há nenhuma transmissão contínua ou automática de dados em segundo plano.

7. Isenção de Garantia

O software é fornecido "no estado em que se encontra", sem qualquer tipo de garantia.
O Licenciante não se responsabiliza por erros, perda de dados ou danos resultantes do uso do software,
na medida permitida por lei.

Esta exclusão não se aplica nos casos em que leis obrigatórias de proteção ao consumidor disponham de forma diferente.

8. Limitação de Responsabilidade

A responsabilidade do Licenciante está limitada – exceto em casos de dolo ou negligência grave – ao valor pago pela licença.
Não há responsabilidade por danos indiretos ou consequenciais (por exemplo, perda de dados, lucros cessantes).
Exceções aplicam-se em casos de lesões pessoais ou responsabilidade obrigatória, como aquelas previstas em leis de responsabilidade por produtos ou em caso de danos à vida, integridade física ou saúde.

9. Rescisão

Esta licença será automaticamente rescindida:

em caso de violação desta EULA
em caso de revogação/desativação por violação de licença (por exemplo, tentativa de contornar a proteção por dispositivo)

Em caso de rescisão:

todo uso do software deve cessar
todas as cópias devem ser excluídas
a revogação pode ocorrer sem reembolso

10. Legislação Aplicável

Este acordo é regido pelas leis da República de Portugal, com exclusão da Convenção das Nações Unidas sobre Contratos de Compra e Venda Internacional de Mercadorias (CISG).

Para consumidores, aplicam-se também as leis obrigatórias de proteção ao consumidor do país em que residem habitualmente.

Para clientes empresariais e pessoas jurídicas, o foro exclusivo será Calheta / Madeira (Portugal).

11. Disposições Finais

Se qualquer parte desta EULA for considerada inválida, as demais disposições permanecerão em pleno vigor.
Ao utilizar o DashCoreX, você concorda com estes termos.

Diese Endbenutzer-Lizenzvereinbarung („EULA“) ist ein rechtsverbindlicher Vertrag zwischen Ihnen („Lizenznehmer“) und
Thomas-Christian Leone, Caminho Serrado das Lilás 41, 9370-635 Calheta, Portugal („Lizenzgeber“),
über die Nutzung der Software DashCoreX („Software“).

1. Gegenstand der Vereinbarung

Diese Endbenutzer-Lizenzvereinbarung (EULA) regelt die Nutzung der Software DashCoreX, einschließlich aller zugehörigen digitalen Inhalte, Komponenten, Konfigurationsdateien, Dokumentationen und sonstiger Elemente,
die dem Lizenznehmer im Rahmen dieser Lizenzvereinbarung auf elektronischem Wege ohne physischen Datenträger bereitgestellt werden.

Die Software wird dem Lizenznehmer ausschließlich zur Nutzung gemäß den Bedingungen dieser EULA zur Verfügung gestellt.
Durch den Erwerb oder die Nutzung der Software erklärt sich der Lizenznehmer mit den nachfolgenden Bestimmungen einverstanden.

2. Lizenzgewährung

Der Lizenzgeber gewährt dem Lizenznehmer eine nicht-exklusive, nicht übertragbare und unbefristete Lizenz zur Nutzung der Software gemäß den Bestimmungen dieser EULA.

Die Software darf nur mit einem gültigen, vom Zahlungs- und Lizenzanbieter Gumroad ausgestellten Lizenzschlüssel verwendet werden.
Die Lizenz ist nicht an bestimmte Geräte gebunden.
Die Lizenzprüfung erfolgt durch Eingabe des gültigen Lizenzschlüssels innerhalb der Software und anschließende Überprüfung über die offizielle Gumroad-Lizenz-API.
Eine Weitergabe des Lizenzschlüssels an Dritte ist unzulässig. Der Lizenznehmer ist für die Geheimhaltung seines Lizenzschlüssels verantwortlich.

Die Testversion ist auf 7 Kalendertage ab der ersten Nutzung beschränkt. Danach ist eine gültige Lizenz erforderlich.

3. Einschränkungen

Dem Lizenznehmer ist es nicht gestattet:

die Software zu dekompilieren, zurückzuentwickeln (Reverse Engineering), zu disassemblieren oder anderweitig in Quellcode zu überführen
die Software zu vermieten, zu verleasen oder unterzulizenzieren
die Software ohne schriftliche Genehmigung öffentlich weiterzugeben
technische Schutzmaßnahmen zu umgehen, insbesondere solche zum Kopierschutz, zur Lizenzprüfung oder zum Schutz vor Mehrfachnutzung auf mehreren Geräten
Lizenzdateien oder Lizenzmechanismen zu manipulieren

4. Eigentum und Urheberrecht

Die Software bleibt geistiges Eigentum des Lizenzgebers.
Der Lizenznehmer erhält keine Eigentumsrechte, sondern lediglich ein Nutzungsrecht gemäß dieser EULA.

Die Software enthält Komponenten Dritter, die unter Open-Source-Lizenzen lizenziert sind (z. B. MIT, Apache-2.0, MPL-2.0).
Eine vollständige Liste befindet sich in der Datei THIRD_PARTY_LICENSES.txt im Installationsverzeichnis.

5. Updates und Support

Der Lizenzgeber ist nicht verpflichtet, Updates oder technischen Support bereitzustellen.
Updates können zusätzlichen Lizenzbedingungen unterliegen, die dem Nutzer vor der Installation angezeigt werden.

6. Datenschutz

DashCoreX speichert und verarbeitet personenbezogene Daten ausschließlich im Zusammenhang mit der Ausstellung und Überprüfung von Lizenzen.
Dies umfasst insbesondere: den Lizenzschlüssel, die E-Mail-Adresse, einen anonymisierten Geräte-Hash (abgeleitet aus dem Hostnamen), den Namen, die Kunden-ID sowie den Aktivierungszeitpunkt.

Die Lizenzprüfung erfolgt manuell durch den Nutzer über eine sichere (HTTPS-)Verbindung.
Es findet keine kontinuierliche oder automatische Datenübertragung im Hintergrund statt.

7. Haftungsausschluss (Gewährleistung)

Die Software wird "wie besehen" bereitgestellt, ohne jegliche Garantien oder Zusicherungen.
Der Lizenzgeber haftet nicht für Fehler, Datenverluste oder Schäden, die durch die Nutzung der Software entstehen,
soweit dies gesetzlich zulässig ist.

Dieser Ausschluss gilt nicht, sofern zwingende Verbraucherschutzgesetze etwas anderes vorschreiben.

8. Haftungsbeschränkung

Die Haftung des Lizenzgebers ist – außer in Fällen von Vorsatz oder grober Fahrlässigkeit – auf den für die Lizenz gezahlten Betrag beschränkt.
Es besteht keine Haftung für indirekte Schäden oder Folgeschäden (z. B. Datenverlust, entgangener Gewinn).
Ausnahmen gelten bei Personenschäden oder zwingender Haftung, etwa nach dem Produkthaftungsgesetz oder bei Verletzung von Leben, Körper oder Gesundheit.

9. Beendigung

Diese Lizenz endet automatisch:

bei Verstoß gegen diese EULA
bei Widerruf/Deaktivierung aufgrund eines Lizenzverstoßes (z. B. Umgehung des Geräteschutzes)

Im Falle der Beendigung:

muss jede Nutzung der Software eingestellt werden
müssen alle Kopien gelöscht werden
kann der Widerruf ohne Rückerstattung erfolgen

10. Anwendbares Recht

Diese Vereinbarung unterliegt dem Recht der Republik Portugal unter Ausschluss des Übereinkommens der Vereinten Nationen über Verträge über den internationalen Warenkauf (CISG).

Für Verbraucher gelten zusätzlich die zwingenden Verbraucherschutzgesetze des Landes, in dem sie ihren gewöhnlichen Aufenthalt haben.

Für Geschäftskunden und juristische Personen ist der ausschließliche Gerichtsstand Calheta / Madeira (Portugal).

11. Sonstiges

Sofern einzelne Bestimmungen dieser EULA unwirksam sein sollten, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
Mit der Nutzung von DashCoreX akzeptieren Sie diese Bedingungen.
